They considering a plan to implement a new electronic health record system. Which makes patient medical records readily available to all doctors affiliated with Oakland Hospital. Including but not limited to, doctors that are employees of said hospital, independent practice associations and doctors working as independent contracts. This proposed EHR system grants all DOCTORS access to the notes of other doctors (cardiologist, General, Surgeons, etc.) on patients seen within the Oakland Hospital System. QUESTION PRESENTED Does this proposal comply with HIPAA and/or case law. Furthermore what steps should the Oakland Hospital take to mitigate any penalties under HIPAA.
